Know If Old Photographs Are Copyrighted

Instructions


1. Examine the photograph carefully for any identifying information. Pay particular attention to the bottom corners and margins, if any.


2. Turn the photograph over and examine the back. You may see a stamp with the copyright information or it may be handwritten.Copyright protects authors or creators of published works, such as photographs and other visual materials, from unauthorized use of an original work. Identifying copyright protection for old photographs can be a particularly "grainy" issue, according to the U.S. Copyright Office, especially for works published after 1978. The 1976 Copyright Act, effective in 1978, made use of copyright notice -- typically the "C in a circle" mark -- optional.
